Joe Giudice has finally caught a break!

After AllAboutTheTEA.com reported that Joe Giudice’s request to await the final decision on his deportation case in Italy was denied, an appeals judge overturned the denial and granted his ‘stay of removal’ petition.

“The appeals court is in fact granting to lift the stay of removal,” an official at the Third Circuit Court exclusively told Radar.

Judge Cheryl Ann Krause made the ruling on October 3.

Joe Giudice was not allowed released immediately and will remain behind bars at the dangerous and dirty Clinton County Correctional Facility in McElhattan, Pennsylvania.

“Mr. Giudice is currently in ICE custody pending removal,” an ICE spokesperson told Radar.

A family source said he is likely to remain in the facility that has been accused of harboring sex abuse for at least a few more weeks.

“He will be there for a while. They will drag this out,” the source insisted.
