Wendy Osefo Says Her Arrest Was Illegal and Wants All Charges Dismissed! 

Real Housewives of Potomac star Wendy Osefo is calling her arrest “illegal” as she moves to have her fraud charges dismissed in court.

On October 17, Wendy’s attorney filed a series of motions in Carroll County, Maryland, demanding that all charges against her be dropped due to what he called “defects in the charging document.”

According to court filings obtained by Us Weekly, the reality star, 41, also asked that “all evidence be suppressed because of an unlawful search or seizure” and that “all wire and verbal communications” be excluded from trial on the grounds of “unlawful interception.” Her attorney further argued that Wendy Osefo was “illegally arrested” and that “all admissions, statements or confessions” obtained during the process should be barred from use, claiming they were “unlawfully obtained.”

Wendy and her husband, Eddie Osefo, were both arrested on October 9 in Westminster, Maryland, after being indicted by a grand jury on multiple counts of insurance fraud, conspiracy to commit fraud, and making false statements to police. Both were released after posting $50,000 bond.

Wendy’s lawyer also asked the court to separate her trial from her husband’s, requesting that “the trial of co-defendants be severed from the trial(s) of this Defendant.” Eddie Osefo currently has no legal representation and has not retained an attorney or legal team for his case. In a separate filing, Wendy’s legal team demanded full discovery from prosecutors, including a list of witnesses, copies of all police reports, and any polygraph results from law enforcement interviews. Her attorney also asked whether any confidential informants were involved in the investigation.

Prosecutors allege that Wendy and Eddie falsely reported a burglary at their Maryland home in April 2024 while vacationing in Jamaica. According to the documents, the couple claimed their house had been ransacked and that luxury handbags and jewelry had been stolen.

However, investigators quickly began to doubt the story. Police noted that no motion was detected inside the home on the couple’s ADT and Ring security systems during their trip — despite the alarm being activated. Authorities also reported that Wendy and Eddie had been monitoring the Ring cameras remotely at the time.

Investigators found the supposed point of entry suspicious, writing in their report: “There was a screen with damage laying on the roof, and the window was not locked … The toilet lid was down and had no debris on it.” Prosecutors claim the Osefos later filed insurance claims with two different companies — Travelers and Jewelers Mutual — claiming a total loss of $450,000 in property and $2,500 in structural damage.

According to court records, Travelers Insurance paid the couple $25,380, which included $4,500 for a missing gold diamond anniversary band.

That same ring, however, appeared in a later Instagram photo of Wendy after the alleged burglary. When questioned by investigators, Eddie denied that any of the listed items had been returned and did not disclose that they had filed a second claim with another insurer.

A subsequent search warrant reportedly uncovered at least 15 items inside the Osefos’ home that had been declared stolen. Authorities said the couple appeared to be “burdened by substantial debt” and accused them of falsifying reports for financial gain. Despite the charges, Wendy’s team maintains her innocence.

Following the arrest, Wendy broke her silence on Instagram, posting a message of faith alongside a glamorous photo shoot. Eddie Osefo also recently took to social media to share a Bible verse, seemingly addressing his and Wendy’s ongoing legal troubles.
