RHOBH Star Erika Jayne Headed to Trial Over $25 Million Spent During Marriage… Will She Have To PAY UP?!
Erika Jayne’s legal drama is far from over.
The Real Housewives of Beverly Hills star, 54, is officially headed to trial after being sued for more than $25 million over funds allegedly funneled through her estranged husband Thomas Girardi’s now-defunct law firm, Girardi Keese. A federal judge has set a trial date for February 10, 2026, according to court documents obtained by Us Weekly.
The lawsuit stems from Tom’s 2020 bankruptcy case after the disgraced attorney was accused of embezzling millions from vulnerable clients, including widows and orphans.
In June 2025, Tom, 86, was sentenced to 87 months in federal prison for wire fraud. Erika, who filed for divorce from Tom Girardi in 2020, has long denied any involvement in his alleged crimes—but that hasn’t stopped the legal system from coming for her.
As part of the bankruptcy, a trustee was appointed to investigate the firm’s finances and recover assets for creditors. In their review, they alleged that more than $25 million was used to cover personal expenses for Erika’s entertainment company, EJ Global, over a 12-year span. That includes glam squads, luxury shopping, credit card bills, and even jewelry.
“The payments by [Girardi’s law firm] were exclusively for the benefit of [Jayne and her company],” the trustee wrote. “The expenses consist largely of expenses to promote Erika personally.”
Records submitted in court list over $14 million in American Express charges made directly by Erika, and an additional $11 million in vendor payments allegedly for her benefit. “Erika either signed or authorized every charge made to the relevant American Express accounts and approved all vendor payments, knowing that she had no ability to pay for the charges and invoices,” the trustee claimed, calling her “an insider” and describing the transactions as a “badge of fraud.”
But Erika’s legal team isn’t backing down.
“In November 2020, Erika filed for divorce and separated from Tom Girardi, moving into a rental,” her attorney Evan Borges revealed. “There is no evidence – because it did not happen – that Erika, an entertainer who never worked at [Girardi’s law firm], knew about or participated in any of the misconduct of Tom Girardi.”
Evan continued, “The Trustee’s lawsuit amounts to senseless bullying and piling on. Erika never received even a penny from the transactions at issue. Her biggest mistake was putting trust in her then-husband.” Despite the mounting pressure, Erika remains focused on her career. She is currently filming Season 15 of The Real Housewives of Beverly Hills and recently confirmed she has a new love interest—John “Shrek” McPhee. The trial is expected to last 7 to 10 days and could dramatically reshape the next chapter of Erika’s post-Girardi life.
With her divorce still unresolved and millions on the line, Erika’s legal battles are far from behind her—and it seems the next season of RHOBH might be her most dramatic yet.
