Federal Prosecutors Skeptical of Tom Girardi’s Dementia Claims, Demand Unredacted Mental Evaluation
Tom Girardi is trying to keep information about his mental acumen sealed, but the prosecutors going after the estranged husband of Real Housewives of Beverly Hills star, Erika Jayne, are fighting for full disclosure.
The feds are demanding that the judge presiding over the disgraced lawyer’s criminal case allow them access to all information regarding his mental state, according to court documents obtained by Radar Online.
Erika filed for divorce in November 2020, one month before Girardi was hit with a lawsuit that accused the lawyer of embezzling over $15 million. He stands accused of pilfering funds owed to clients and using the cash to support an extravagant lifestyle and his wife’s pop star career.
The trustee overseeing Girardi’s bankruptcy case spilled stunning details about the lawyer’s finances in September 2022, amid a legal dispute with two litigation lenders who previously worked for Girardi’s now-defunct law firm.
The trustee noted in court docs that the $2 million owed to family members of victims of a Boeing plane crash “while shocking and unconscionable, is only the tip of the iceberg.”
The lawsuit read — “The Trustee’s investigation of the Firm’s financial records revealed that over the last ten years, Thomas and his cohorts stole at least $14,000,000 in settlement funds that should have gone to the Firm’s clients.”
The trustee stated that Girardi used a trust account tied to his firm as “his personal piggy bank.” The lawyer allegedly deposited $41 million into the account to cover checks used to support the couple’s high-end habits.
“The deposits were insufficient to cover his use of the funds,” the trustee explained.
The lawsuit revealed the massive number of claims filed against Tom’s estate at the time—682 in total. The claims totaled $495,912,891.48, in September of last year.
The trustee said that Tom was spending millions on “cars, furs, clothes, trips, and jewelry and other items for himself, his celebrity “Real Housewives of Beverly Hills” wife, Erika, and other friends and Girardi Keese employees and partners,” while bilking his clients and business partners.
Tom Girardi moved out of the Pasadena mansion he shared with the reality star and into a senior assisted living center, in 2021. At this point, the lawyer had been diagnosed with dementia and his brother, Robert, had taken over his finances as a conservator.
Prosecutors recently hired an expert to determine Girardi’s competency as the criminal case moves forward. The expert concluded that Girardi was “competent to stand trial.”
The feds noted in documents that they had agreed to allow Girardi’s lawyers to review the expert’s report and redact any private information. Girardi’s team went on to redact the majority of the report, so now prosectors are demanding that they be allowed access to the entire evaluation.
