Denise Richards’ Paycheck May Be Garnished Over Husband Aaron Phypers’ $228K Debt Battle!
Real Housewives of Beverly Hills alum Denise Richards is being pulled into her husband Aaron Phypers’ ongoing legal troubles, as a creditor seeks to use her earnings to help settle his six-figure debt.
According to court documents obtained by InTouch Weekly, the Denise Richards & Her Wild Things star, 54, is caught in the fallout of a business loan Aaron, 52, defaulted on. The wellness center owner was sued by Creditors Adjustment Bureau in 2022 after failing to repay a $190,000 loan he took out in 2019 with an 11% interest rate. The total owed has now ballooned to $228,000, and the creditor wants to recover that money through Denise’s income.
“Denise Richards currently is, and at the time the debt was incurred was, the spouse of Defendant and Judgment Debtor Aaron William Cameron Phypers … and is responsible for the community property debts,” the creditor’s attorney argued in legal filings, adding that they’re seeking to attach Denise’s “wage earnings and other assets” to satisfy the judgment.
But Aaron is pushing back — hard. His legal team has challenged the attempt to tap Denise’s wages, claiming there is no “admissible evidence” that the two are even married. One article submitted by the creditor that mentioned their marriage was shot down by Aaron’s attorney as “inadmissible hearsay.”
Furthermore, Aaron’s team argues that there’s no proof the couple’s assets — or Denise’s earnings — are community property. “Judgment creditor presents no evidence that [Aaron] and [Denise’s] assets are community property,” his legal filing states. “An attachment order or other collection order that permits recovery from unspecified assets is inappropriate and overly broad.”
The documents go on to explain that even if the pair are legally married, not all marital earnings qualify as community property, especially if prior agreements were made. “Married couples can enter into transmutation and other agreements that change the character of assets and earnings,” Aaron’s attorney noted. “
By failing to give proper notice to [Denise], [Creditors Adjustment Bureau] precludes her from presenting evidence that would provide an exception.” Aaron has not denied owing the money.
In fact, he acknowledged that financial hardship prevented him from fulfilling the agreed-upon repayment schedule, which included hefty five-figure monthly payments through early 2025.
This isn’t Aaron’s only legal issue. In November, he was also sued for fraud and breach of contract by a widower who alleged wrongdoing related to Aaron’s wellness business. While Denise has not publicly commented on the matter, it’s clear her paycheck is now at the center of a legal tug-of-war — one that could have serious financial implications for the couple.
