The new year kicks off with more drama for Mauricio Umansky, who’s tangled in a fiery lawsuit accusing him and his real estate company, The Agency, of pocketing a $3.5 million PPP loan they allegedly didn’t need. With fraud allegations piling up and his estranged wife Kyle Richards making headlines of her own, Mauricio’s 2024 is already looking messy.
Relator LLC initially filed the lawsuit in July 2023, claiming that Mauricio and The Agency improperly accessed forgivable PPP loans meant to help struggling businesses during pandemic shutdowns.
They argue that The Agency did not qualify for the loan, given its reported $6 billion in sales in 2020 and $6.5 billion in 2021, as well as Mauricio’s personal net worth, estimated at $100 million.
In response to The Agency’s motion to dismiss the case, Relator hit back in newly filed court documents, asserting that the company’s arguments fall flat. “This is a case about greed during a national health emergency,” their lawyer stated.
The Agency’s legal team had argued that Relator’s claims lacked merit because the company has no direct link to Mauricio or The Agency and had gathered its information from publicly available databases. However, Relator refuted this defense, claiming the argument sidesteps the core issue of potential wrongdoing.
“Defendants do not argue that they engaged in no wrongdoing,” Relator’s lawyer stated in court documents obtained by In Touch. “Instead, Defendants claim that the [first amended complaint] contains insufficient allegations – not on the facts alleged – but only on how [Relator LLC] came to realize the facts.”
Relator also pointed out that The Agency’s motion to dismiss hinges on the idea that Relator lacks direct knowledge of the alleged fraud, rather than a denial of the claims themselves.
If the lawsuit is successful, it could have significant financial repercussions for Mauricio and The Agency. Relator is seeking a judgment for three times the damages allegedly sustained by the United States, along with civil penalties.
The case has been a persistent thorn in Mauricio’s side, coinciding with his ongoing marital troubles with Kyle Richards.
Despite the challenges, Mauricio and his legal team remain firm in their stance, but Relator’s latest filings indicate they are not backing down. As the case heads toward further legal proceedings, all eyes will be on how Mauricio and The Agency address these allegations.
