Kim Zolciak’s daughter, Ariana Biermann, has entered a plea of not guilty to the six misdemeanor charges against her, demanding a jury trial.
As reported by In Touch, According to court documents obtained by the publication, Ariana, 22, has contested the charges and requested that evidence prosecutors plan to use be excluded from her trial.
Ariana’s legal team argues that her arrest on August 13, 2022, by a Forsyth County Sheriff’s Department officer was unjustified. “At the time of the initial detention, sufficient facts did not exist to support even an articulable suspicion that Ariana was under the influence of alcohol or drugs, or that any other criminal activity was underway,” her lawyer stated. They claim that no traffic violations occurred prior to the officer’s stop, suggesting that the detention was an unlawful warrantless seizure, infringing upon her Fourth Amendment rights.
The defense is seeking to have any evidence obtained illegally be deemed inadmissible. Additionally, they argue against the use of evidence from field sobriety tests, expressing concerns over the officer’s training and conduct during the tests.
As reported by In Touch, Ariana faces six charges: driving under the influence of multiple substances, driving under the influence of alcohol, possession of a drug-related object for carrying a vape pen with a THC cartridge, improper turn, failure to obey traffic signs or signals, and underage possession of alcohol. These charges were filed by the State of Georgia earlier this month.
The arrest occurred after Ariana reportedly collided with another vehicle. During the traffic stop, Ariana’s boyfriend, Hudson McLeroy, was also detained. According to the police report obtained by TMZ, officers detected the smell of alcohol on Ariana, though she denied drinking. She admitted to having used a THC vape pen the previous night but insisted she had not consumed alcohol before driving.
Following a sobriety test in which officers noted a “noticeable sway,” Ariana was arrested. Her attorney, Justin Spizman, defended her by stating, “Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI. Despite Ariana’s constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol. That was not the case. She wholly denies these allegations and intends to fight these charges because she is not guilty of them.”
In other news related to the Biermann family, Ariana’s sister, Brielle Biermann was recently sued over an alleged car accident. Sources close to Brielle, 27, deny her involvement or presence in Georgia on the date of the incident.
