Judge Demands DFCS Records in Mama June’s Custody Battle Against Anna’s Ex Amid Abuse Allegations!
Mama June Shannon scored a small but significant win in her contentious custody battle against her late daughter Anna Cardwell’s ex-husband, Michael Cardwell.
Court documents obtained by In Touch reveal that the court has approved June’s request for records from the Department of Family and Children Services (DFCS). This move allows June to gather evidence crucial to the custody proceedings concerning her 11-year-old granddaughter, Kaitlyn.
“Such evidence and testimony is material to the matters before the court to allow the court to make an informed decision regarding the best interest of the minor child in this custody action,” June’s motion stated.
The judge has mandated that a representative from DFCS appear in court to present records related to Kaitlyn, Anna’s daughter from a previous relationship.
Anna Cardwell passed away at the age of 29 after a brief battle with cancer. She left behind two young daughters: Kaitlyn and 8-year-old Kylee. Kaitlyn’s father is Michael Cardwell, while Kylee’s father is Michael Cardwell.
In the wake of Anna’s death, Mama June, 44, swiftly filed an emergency petition to gain custody of Kaitlyn, asserting that Kaitlyn had already been living with her before Anna’s passing and that it would be in Kaitlyn’s best interest to remain in her care. A judge granted June temporary custody pending further hearings.
Michael Cardwell has since initiated a separate custody case, arguing that he had raised Kaitlyn as his own during his marriage to Anna and that it would be beneficial to keep Kaitlyn and Kylee together after Anna’s death. Michael also alleged that separating the siblings would be detrimental.
Michael has accused Mama June of having a “sordid” relationship with Anna during her lifetime, which June vehemently denies. She has countered by claiming that Michael was abusive towards Anna and the children.
“During his marriage to Anna, [Michael] frequently physically abused Anna and the child and it would not be in the child’s best interests to be in [Michael’s] care and control,” Mama June’s petition asserts.
Michael’s attorney, Donald Lewis Roberts, has strongly refuted these allegations.
“Michael denies these allegations. This is the first time that any of these allegations have been made against him. He and Anna had a great relationship when they were married and simply separated due to differences in opinions and personalities,” Roberts said.
He continued, “They managed to get along throughout the divorce as well and had maintained a good relationship with his family and him. They’ve always stuck together for their children, and we will see what proof Ms. Shannon has for these types of claims, these very serious claims, to make on somebody — if she has any proof at all.”
In addition to her subpoena request to DFCS, Mama June has also issued subpoenas to Anna’s widower, Eldridge Toney, and her ex-husband, Mike Thompson, asking them to testify on her behalf at the upcoming hearing.
Earlier this month, Kaitlyn submitted a declaration to the court expressing her preference to live with her maternal grandmother. “I am electing and hereby expressing my desire and intent to reside primarily with my maternal grandmother, June Shannon. I do not wish to have set visitation with Michael Cardwell,” Kaitlyn stated in her declaration.
Kaitlyn also expressed her wish to speak directly to the judge to convey her preferences. As of now, a judge has yet to make a final ruling in this ongoing custody battle.
