‘Vanderpump Rules’ Star Tom Sandoval Pushes to Dismiss Rachel Leviss’ Lawsuit

Tom Sandoval has responded forcefully to ex-girlfriend Rachel “Raquel” Leviss’ lawsuit alleging revenge porn, invasion of privacy, and eavesdropping, claiming she acted in “bad faith” and was negligent in handling the aftermath of their relationship.

Rachel, a former cast member of Vanderpump Rules, filed her lawsuit against Tom and Ariana Madix earlier this year, alleging she was victimized by the unauthorized filming of sexually explicit videos.

Her attorneys argued that the scandal surrounding their affair, dubbed “Scandoval,” had a devastating impact on her life, leading to prolonged mental health treatment and her departure from the show.

In newly obtained legal documents reviewed by PEOPLE on July 18, Sandoval’s attorneys counter Leviss‘ claims, asserting that any damages she suffered were partially or entirely due to her own negligence and breach of duty.

They argue that Rachel failed to mitigate her alleged damages and knowingly exposed herself to the consequences of her actions.

The legal response invokes the doctrine of “unclean hands,” contending that Leviss should be barred from seeking damages because she did not act fairly in the matter.

Tom’s attorneys also accuse Rachel of acting in bad faith, asserting that her lawsuit was unreasonable and lacked good faith intentions.

They highlight Rachel‘ status as a public figure and argue that she waived her right to privacy, making the case a matter of legitimate public interest.

Consequently, Sandoval’s legal team is requesting that Rachel‘ lawsuit be dismissed and that she be required to cover Tom’s attorney fees.

In her initial lawsuit filed in February, Leviss described feeling humiliated and vilified by the public fallout from the alleged videos, claiming it severely damaged her career and personal reputation.

She sought compensatory damages, the cessation of video distribution, destruction of all copies, reimbursement of attorney fees, and any further relief deemed appropriate by the court.

The legal battle between Sandoval and Rachel continues to unfold, with both parties vehemently defending their positions in what has become a highly publicized and contentious dispute.
