Just months after its much-anticipated opening, Penny has filed a lawsuit accusing Ariana and Katie of failing to honor their partnership agreement, as detailed in court documents obtained by PEOPLE.

According to the complaint, Davidi asserts that she was appointed as the Chief Operating Officer and Director of Culinary at Something About Her, with a promised 10% stake in the business.

The agreement allegedly included a monthly salary that was set to increase over time, contingent upon her involvement in managing the restaurant’s operations.

However, Penny claims that Ariana and Katie have reneged on these terms, prompting her legal action to enforce their original agreement.

The restaurant, located in West Hollywood, finally opened its doors in May after overcoming various delays including permitting issues.

Ariana and Katie, known for their roles on the reality TV series, had initially announced their plans to enter the food industry back in 2022, expressing optimism despite the challenges they faced along the way.

In an interview with PEOPLE prior to the grand opening, Madix and Maloney spoke candidly about the obstacles they encountered. “We both believed that it would always happen, that we were going to make it happen,” Madix said optimistically, while Maloney admitted to learning valuable lessons as newcomers in the restaurant business.

Meanwhile, Penny has voiced her concerns about the restaurant’s direction since her departure, criticizing the menu’s execution compared to her original vision.

In an exclusive interview with The U.S. Sun, she remarked, “This is not what I put together. This is not the vision that I had for this place,” highlighting discrepancies in ingredient use and menu coherence.

Despite contributing ideas such as introducing Boursin cheese, Penny feels the current offerings fall short of what she envisioned for Something About Her.

Looking forward, Davidi remains skeptical about the restaurant’s future, suggesting potential challenges in sustaining the business long-term.

She also maintains her claim of ownership in the venture, citing her involvement in trademark filings related to the brand.

As the legal proceedings unfold, the outcome remains uncertain, with Davidi seeking judicial validation of her alleged partnership terms.

For Madix and Maloney, they have yet to publicly respond to the lawsuit.
