Court documents reveal that NetJets Aviation, Inc. initiated legal action against Simon Guobadia’s business, Simcol Petroleum Limited Company.

The lawsuit, initially brought to light by YouTuber Tisa Tells, details that NetJets operates a “fractional aircraft program.” This program involves NetJets in the business of selling and leasing fractional interests in private jets as part of the NetJets Fractional Program. Through a fractional aircraft program, multiple owners can share both the usage and the costs associated with an aircraft.

NetJets has claimed that Simcol Petroleum Limited Company entered into an agreement in August 2020, according to the lawsuit. Under this agreement, Simcol committed to leasing a 12.5% interest in a Cessna Citation aircraft. Furthermore, NetJets states that Simcol agreed to elevate its lease to a 15.62% interest on July 3, 2021.

NetJets has alleged that the defendants violated the terms of the Program Agreement by not paying the due amounts in a timely manner, leading to the termination of the agreement on or around February 28, 2023. According to the lawsuit, at the time the Program Agreement was terminated, the defendant owed NetJets a total of $974,213.11 under the agreement’s terms.

In the lawsuit, NetJets disclosed that they had reached a confidential agreement with Simcol in August 2023. Under this agreement, Guobadia’s company purportedly agreed to pay NetJets $839,000 in monthly installments, including interest. NetJets acknowledged receiving the first installment payment of $25,000 from Simcol. However, Simcol then allegedly failed to make the second installment payment, which was due on October 2, 2023.

The lawsuit asserts that Simcol has not made any further payments beyond the initial installment. Consequently, the legal action is seeking a court order for Simcol to pay the remaining $814,000 owed on the agreement, in addition to interest.

Moreover, NetJets has requested that the court mandate Simon to cover the legal expenses NetJets has incurred in relation to the case. As of now, Simon has not provided a response to the lawsuit.
