Love During Lockup star LaTisha Collier, is under investigation for possible bankruptcy fraud. The trustee recommended the dismissal amid allegations that the filing was a ploy to stall eviction proceedings against Boss Tax and Accounting Services in Davenport, Iowa.

Starcasm covered the details of the case, which included the company’s decision to not retain an attorney and skipping a required filing fee. Collier reportedly hoped to make the payments at a later date, an option only available for individuals not businesses.

The judge cited seven of Collier’s personal bankruptcy filings in his decision to dismiss Boss T&A’s most recent bankruptcy. Collier’s only successful bankruptcy was a joint effort with her husband, Keith, which was filed in 2009. The couple failed to comply with their side of deal, ultimately nullifying  their win.

The judge stated of the case — “Although debtors initially received a general discharge, that discharge was revoked as a result of their failure to turn over their nonexempt refunds to the chapter trustee.”

The judge cited an interview Collier did with Kiki and Kibbitz, during which she implied that she filed the bankruptcies as a tactic to stall creditors.

“If accurate and verifiable, that information should be troubling to anyone concerned about maintaining the integrity of the bankruptcy system that the United States Congress has established. It is troubling to this Court — especially when considered in conjunction with Latisha Collier’s long history in this forum in general and with her behind-the-scenes activity in this case in particular.”

Collier filed a response opposing the judge’s dismissal, on January 17. The judge noted her objection, as well as the interview and various Starcasm articles breaking down the case within the context of potential bankruptcy  fraud.

The judge stated — “Notably, in her objection as it relates to all of the foregoing allegations of bad faith, Latisha Collier merely states ‘[t]here is no bankruptcy fraud.’ Curiously, that statement seemingly is at odds with the third party information referenced in the preceding paragraph.”

The trustee asked that Boss T&A be barred from future bankruptcy filings for a set time period due to the bad faith allegations. The judge disagreed, but noted that he had referred Collier to the U.S. Attorney’s office in order to investigate potential bankruptcy fraud, due of her actions relating to the multiple filings.

The judge noted three relevant bankruptcy code statutes that the reality TV personality may have violated. Collier could be facing fines and/or up to five years in prison for the most serious potential violation.
