Heather Gay Settles Lawsuit Involving Her Beauty Lab Business Amid Monica Garcia’s Drama!

Heather Gay has settled a federal lawsuit involving her and her business, Beauty Lab + Laser LLC. The Real Housewives of Salt Lake City star struck a confidential deal with photographer, Gavin O’Neill, after she was accused of copyright infringement.

Court documents obtained by Radar Online revealed that O’Neill and Gay notified the court of their recent agreement. All claims against Gay and her business will be dismissed, per the deal.  

O’Neill, who has had his work published in Vogue, Cosmopolitan and GQ, accused the reality star of using his images of models to advertise her business. He claimed that one photo was used to illustrate “what can be achieved with Beauty Lab’s HydraFacial services, and urged its users to book an appointment online.”

The lawsuit accused Gay of using multiple photos snapped by O’Neill without his consent. 

He stated in the suit — “O’Neill is informed and believes Defendants (including their employees, agents, contractors or others over whom they have responsibility and control) used, displayed, published, and otherwise held out to the public O’Neill’s original and unique Photographs in order to acquire a direct financial benefit from the use of the Photographs through revenue from the sales of Beauty Lab’s products and services.”

The photographer claimed that he tried to settle the issue with the Bravo star, but she refused to cooperate. The lawsuit demanded a payout in excess of $450k.

Gay denied all accusations of wrongdoing, and disputed O’Neill’s claim that he had been damaged by her actions. 

Her response read — “Defendant’s infringement was not willful. Defendant removed the allegedly infringing photographs immediately upon receiving notice.”

News of the settlement deal followed the dismissal of another lawsuit involving Gay and her company.

The case stemmed from a 2019 agreement that stated that Gay’s then-co-star, Monica Garcia, was to receive $2,449 worth of “cosmetic injections” from Beauty Lab. According to the lawsuit from Beauty Lab’s legal team, Garcia made an initial payment of $449 and agreed to subsequent monthly installments of $200 for ten months. Beauty Lab contended that Garcia had defaulted on these payments following her initial contribution, per The U.S. Sun.

Beauty Lab’s claim suggested that the spa had endured “significant losses and damages,” due to Garcia’s alleged non-payment. The company is seeking compensation exceeding $2,000, as well as coverage for legal fees and other related costs.

In September, Garcia’s lawyers filed a countersuit that claimed that no further payments were made because the injections she received were improperly administered and failed to produce the promised results.

Her legal team argued that Beauty Lab’s services were subpar, not meeting industry standards nor fulfilling the promised care, thereby entitling Garcia to withhold further payment.

She claimed that she had “received defective, negligently given injections, which did not have the intended, promised result.”

The since-fired Bravo star stated — “The parties reached an oral accord and satisfaction wherein Monica paid for another, competent party to fix the damage to Monica’s nose and lips caused by the incompetent, negligent actions of Beauty Lab’s staff, and Beauty Lab was entitled to no further payment.”

Last month, the judge dismissed the case against Gay, stating that it was filed past the statute of limitations.
