Kim Zolciak and Kroy Biermann Ignore $300k Lawsuit Over Unpaid Loan As Foreclosure Looms
Kim Zolciak and her estranged husband, Kroy Biermann, have landed in hot water after reportedly skipping out on a court date. The reality TV couple seemingly failed to show in court and now purportedly face a potential six figure judgement.
Court documents obtained by Radar Online reveal that Simmons Bank requested a default be entered as the first step in obtaining a default judgment against the Real Housewives of Atlanta alum and her soon-to-be ex. The lawsuit was filed on July 5, 2023 and the couple was served with paperwork on August 16. The bank stated that Kim and Kroy failed to respond by the required September 15 deadline.
Simmons Bank alleged that the couple took out a $300k line of home equity credit with an initial maturity date of December 2016. The suit stated that Kim and Kroy modified the loan in August 2017, which pushed back the maturity date to December 2017. In 2018, the loan was modified a second time with the couple’s acknowledgement that they owed $271k in principal.
The bank stated that Kim and Kroy agreed to monthly payments of $1,132.46, beginning in February 2018, with the last payment due in January 2038. Simmons accused them of defaulting on the loan, as the last payment received was in October 2022. Simmons notified the couple but claimed that Kim and Kroy refused to pay what they owed in back payments. The bank is now demanding that the entire loan be paid off immediately. The institution stated that the contentious duo owes $213k plus $1,700 in interest.
Kim and Kroy remain living in the family home as their ongoing divorce grabs headlines. They recently listed the Georgia mansion for $6 million amid ongoing foreclosure proceedings. The estranged couple faced foreclosure back in February, but the scheduled auction was canceled one month later.
Kim and Kroy have been slammed with multiple lawsuits over the past several months, including a massive tax lien by the I.R.S. The government agency slapped the couple with a whopping $1,147,834.67 bill shortly before they announced their breakup.
Kim shares four children with the former Atlanta Falcons linebacker, Kroy Jr., 11, and Kash, 10, and 9 year-old twins Kaia and Kane. Kroy adopted Kim’s adult daughters, Brielle, 26, and Ariana, 21, after their 2011 nuptials. The newlyweds went on to star in Bravo spinoff series, Don’t Be Tardy, which ran for eight seasons.
Last month, Kim filed a motion to dismiss Kroy’s second divorce petition, citing recent sexual romps to dispute his claim that their marriage was “irretrievably broken.”
Kroy responded, reiterating that he had “no desire to reconcile.”
“The fact that he engaged in sexual relations with [Zolciak] does not indicate a desire to reconcile,” court documents stated, adding that he “remains steadfast in his desire to divorce.”
Police have been dispatched to the family home on multiple occasions to break up marital skirmishes as the couple’s divorce rages on in court.
