Kim Zolciak Skips Court Appearance Over Kroy Biermann’s Divorce Filing
Kim Zolciak failed to appear in court to dismiss her estranged husband, Kroy Biermann’s divorce filing, but an insider later claimed that she had a good excuse.
The Real Housewives of Atlanta alum failed to appear via Zoom in court on Wednesday, per an Entertainment Tonight report.
A source spoke to People about Kim’s no-show, explaining to the outlet—”She was shooting in Colombia and could not make it in time because of production schedules. She has to make money because things are very tight right now with money.”
Kim Zolciak is currently in production for Season 2 of MTV’s revived reality series, “The Surreal Life,” in Colombia.
Kroy’s lawyer, Marlys Bergstrom, reportedly asked the court to permit his client to sell the pair’s marital home, despite Kim’s absence. Kroy confirmed to the judge that the Alpharetta, Georgia mansion will land in foreclosure on November 7.
Earlier this month, Kroy’s lawyer confirmed to Us Weekly that his client was pleading with the “Real Housewives of Atlanta” alum to sign a joint consent agreement to put the $3 million home on the market. Bergstrom stated that selling their family estate would enable them to clear significant debt.
Kroy filed for divorce from the former reality star in May, then refiled in August after a brief reconciliation. He also requested an emergency hearing to expedite the sale of their house.
“If the court orders it then the court can enforce the order. It is taking control out of the hands of the parties,” Bergstrom told Us at the time. “And this is exactly what needs to be done at this point.”
Kim Zolciak told TMZ the next day that selling the marital home had been a “mutual” decision, claiming that she had “told him what to do.”
On Monday, Kim filed a motion to dismiss Kroy’s second divorce petition, citing recent sexual romps as proof that his claim that their marriage was “irretrievably broken” was false.
Kim stated in documents that the two had “engaged in marital sexual relations on multiple occasions since the filing of the petition for divorce,” and they “most recently” hooked up on September 7.
The motion states that both parties must “once again affirm that the marriage is indeed irretrievably broken” by filing yet another petition in order to advance the divorce.
Kim shares four children with the former Atlanta Falcons linebacker, Kroy Jr., 11, and Kash, 10, and 9 year-old twins Kaia and Kane. Kroy adopted Kim’s adult daughters, Brielle, 26, and Ariana, 21, after the couple wed, in 2011.
Kim took to her Instagram Stories earlier this month to share that she remained hopeful about saving her marriage.
“I’m living here not going anywhere!” she said. “Been working on our marriage and have been living together as husband and wife. The lies daily are too much.”
