Kroy Biermann Remains Committed to Divorcing Kim Zolciak Despite Sexual Relations!
The state of Kroy Biermann and Kim Zolciak’s marriage cannot be salvaged by any amount of sex.
On Tuesday, the former Atlanta Falcons player filed a response to the Real Housewives of Atlanta alum’s motion to dismiss their divorce, asserting that sexual relations do not “invalidate” his divorce petition.
Kroy acknowledged that he and his estranged wife have indeed been engaging in sexual activity. However, he reiterated in the new court documents, which Page Six obtained, that he has “no desire to reconcile.”
“The fact that he engaged in sexual relations with [Zolciak] does not indicate a desire to reconcile,” the documents state, adding that he “remains steadfast in his desire to divorce.”
The 38-year-old former linebacker also alleged that his 45-year-old wife is employing her dismissal request as a means to “delay” their divorce proceedings because she is unwilling to part with their $3 million Georgia estate.
“She has stated that she prefers to file for bankruptcy; a move that will ensure that the parties and their children will remain under the same roof for a significant period of time,” the documents state.
Previously, Kroy had mentioned that their marital home was under the threat of “imminent” foreclosure. However, in this recent filing, he unequivocally states that the mansion will indeed face foreclosure in November.
The former Don’t Be Tardy star remains committed to expeditiously selling the house so that both he and Kim can access any remaining equity, allowing them to secure separate residences. This move is driven by his desire to remove their four minor children from the “unhealthy environment” in which they are currently residing.
Kroy is urging the court to reject Kim’s motion to dismiss the divorce and instead make a decision regarding the sale of the marital home.
In her filing, submitted on Thursday, Kim contended that their marriage wasn’t “irreparably damaged” due to their ongoing intimacy. She asserted in the court documents that she still believed their marriage was “workable.”
Kroy initiated his second divorce filing on August 24, following a brief period during which the estranged couple had initiated divorce proceedings but then reconciled.
Kroy is actively pursuing sole custody of their four minor children: Kroy Jr., aged 12, Kash, aged 11, as well as the 9-year-old twins, Kaia and Kane.
