Kim Zolciak and Kroy Biermann hit with a financial blow: the duo is reportedly “financially strained” with over $1 million in outstanding taxes for their Georgia estate, as per divorce papers.
The ex-Atlanta Falcons star attributed their financial struggles primarily to Kim Zolciak’s extravagant spending habits, as revealed in the recently unearthed documents, “reckless spending habits and love for online gambling.”
Kroy Biermann, 38, submitted legal documents in Fulton County on Monday, in response to Kim’s plea from the previous week, seeking the divorce proceedings to be presided over solely by a judge, rather than a judicial officer.
He also requested the courts to let a judicial officer handle the case to expedite the process, “sale of the marital residence can be heard and ruled upon.”
Kroy further noted in his documents that should his request be declined, “it could well be months before any order regarding the marital residence can be made.”
He stated that BMW Financial has lodged a lawsuit against him due to an “outstanding liability of approximately $400,000” with an additional $100,000 lawsuit from Capital One/Saks looming over Kim’s head.
Kroy further mentioned a separate lawsuit regarding a line of credit “granted by a Bahamian casino.” In the documents, he stated, “The only asset the parties have is the marital residence and they are facing foreclosure on the home for a second time.”
According to documents in May, the pair had a pending debt to the IRS amounting to over $1 million in back taxes from the years 2013, 2017, and 2018.
Owing to their financial strain, Kroy noted that they are compelled to cohabitate as neither can afford separate living arrangements.
“Despite the IRS lien, there is some equity in the marital residence however, the home must be placed on the market immediately because foreclosure looms on the horizon.”
Kroy has made a bold legal move by requesting the court’s intervention to appoint a Guardian ad Litem for their four beloved minor children currently residing at their marital abode.
Kroy and Kim’s have four children together: Kroy, 11, and Kash, 10, and twins Kaia and Kane, 9. Kroy adopted Zolciak’s adult daughters from a previous relationship, Brielle and Ariana Zolciak-Biermann.

the couple’s opulent Georgia mansion faced the specter of foreclosure back in February, slated for a public auction in March. Rumor has it that Kroy and Zolciak found themselves in hot water due to their reported failure to meet the obligations of a hefty $1.65 million loan taken out against the property back in 2012. But just when it seemed like their dream home was slipping away, fate took an unexpected twist, and the foreclosure auction was ultimately called off.
The Kroy-Kim divorce saga kicked off in dramatic fashion back in May, when Kroy initiated proceedings by officially filing for divorce. In the legal documents, he declared their 11-year union as “irretrievably broken.” However, the plot thickened mere hours later when Kim swiftly countered with her very own divorce petition, ensuring that this high-profile split would be anything but low-key.
Their legal dance took an unexpected twist when, in July, they mutually agreed to voluntarily dismiss their initial divorce petition. However, the plot continued to thicken when Kroy, undeterred, made a comeback in August by re-filing for divorce.
In his new filing, Kroy boldly requested the court to grant him “exclusive, temporary, and permanent use and possession of the marital residence” nestled in Alpharetta, setting the stage for what promises to be a contentious battle over their shared abode.
“Petitioner (Kroy) shows that Respondent (Kim) should be restrained and enjoined from coming about the marital residence after she vacates,” documents stated.
