Marc Daly Demands the Court ARREST Kenya Moore After 4-Year-Old Daughter Filmed During ‘RHOA’ Argument
Kenya Moore’s estranged husband, Marc Daly, has asked the court to find the Real Housewives of Atlanta star in contempt after their daughter, Brooklyn, was present for an argument on the Bravo reality show.
If a party is found in contempt of court, they may face various punishments. First, they may have to serve a jail sentence. The Georgia Family Code states that contempt can be punishable by up to six months in jail. The at-fault party may also have to pay fines, cover legal costs, and complete community service hours.
Marc Daly is angry that his 4-year-old was sleeping in a hotel room when Kenya’s co-star, Marlo Hampton, tried to kick down the door to her room, according to court documents obtained by Radar Online.
Kenya Moore is embroiled in a nasty divorce battle with her ex, who argued to keep Brooklyn away from RHOA as part of the pair’s initial custody case. Marc and Kenya’s divorce trial is scheduled to begin later this month.
Both parties previously agreed that Kenya Moore would have sole custody of their daughter, and the judge determined that the minor child could appear on the show, with limitations set in place. Marc was granted visitation.
The judge said at the time that he was “not convinced, and no evidence has been shown” that Kenya would place the child in “any environment that might not be in the minor child’s best interest, or may in any way be considered dangerous or inappropriate.”
The judge stated in a court order that Kenya Moore would have the authority to decide whether or not to include Brooklyn while filming RHOA. However, the judge stipulated that Kenya must discuss any economic opportunity offered to Brooklyn with her father.
The order stated — “[Kenya] shall notify [Marc] of any opportunity where the minor child will appear on camera and shall advise [Marc] of the content of the appearance; the minor child will only be involved in opportunities that are age appropriate.”
Marc claimed in the newly filed motion that Kenya violated the court order by allowing Brooklyn to film a Home Run Inn Pizza commercial without consulting with him. Marc explained that he learned of the commercial via the internet.
The order stated — “[Marc] shall be allowed daily telephonic, and/or video visitation with the minor child.”
Marc claimed that he “repeatedly requests calls and Facetime with [Brooklyn], and provides available times” but that Kenya failed to respond.
He alleged that he only spoke to his daughter twice in June, accusing his ex of refusing to “cooperate with in-person visits.”
Marc requested that the court take note of Kenya’s actions during their upcoming divorce trial. He also asked that the RHOA star be ordered to pay all of his legal bills linked to his latest complaint.
The Bravo star has not responded to Marc’s latest motion.
Earlier this week, Kenya demanded that her soon-to-be ex cover her legal expenses amid the contentious divorce war. Marc previously accused the Bravo star of “dragging her feet” and failing to adhere to the terms of an agreement hammered out at a May 11 mediation, per a Radar Online report.
Kenya denied that any such agreement existed.
The legal document stated — “During mediation, it was clear Respondent was not negotiating in good faith, and another clear attempt to reach a divorce agreement. After 7.5 hrs of mediation, and based on advice of counsel [Kenya] chose to end the session due to Respondent’s inability to agree on most essential terms.”
The reality star requested that the New-York based restauranteur be required to cover all attorney fees she accrued for fighting the non-existent agreement.
