Kenya Moore Demands Marc Daly Pay Her Legal Fees After He Attempts To Stall Child Support Negotiations
Real Housewives of Atlanta star Kenya Moore is requesting that her soon-to-be ex-husband, Marc Daly, cover her legal expenses as the ex-couple’s contentious divorce battle continues to play out in court.
Kenya Moore is fighting back after Marc Daly accused the reality tv star of “dragging her feet” and failing to adhere to the terms of their agreement following a seven-hour mediation on May 11, according to RadarOnline.
Kenya Moore, represented by her lawyer at the contentious meeting, says there was never an agreement. “During mediation, it was clear Respondent was not negotiating in good faith, and another clear attempt to reach a divorce agreement,” the legal document states. “After 7.5 hrs of mediation, and based on advice of counsel [Kenya] chose to end the session due to Respondent’s inability to agree on most essential terms.”
The document further states, “it is well established that no contract exists until all essential terms have been agreed to, and the failure to agree to even one essential term means that there is no agreement to be enforced. An agreement between two parties will occur only when the minds meet at the same time, upon the same subject matter, and in the same sense.” The 52-year-old reality star is asking the New-York based restauranteur to cover the attorney fees she’s accrued for fighting the non-existent agreement. Marc has no legal representation after being dropped by his lawyer, Regina Edwards, in April.
Kenya and Marc separated in 2019 after two years of marriage. The reality tv star officially filed for divorce in 2021, requesting primary custody of their daughter Brooklyn and child support. The Bravolebrity said the couple’s marriage was irretrievably broken with no hope of reconciliation.
Marc Daly consented to the divorce and agreed to allow Kenya to have primary custody. Nevertheless, he insisted on having joint legal custody.
Prior to the divorce filing, Kenya filed a custody suit for their daughter, Brooklyn. In the course of the dispute, Marc tried to prevent Brooklyn, 4, from participating in the filming of The Real Housewives of Atlanta without his permission.
In his petition, Marc Daly demanded 50% ownership of the Georgia mansion Kenya purchased before their marriage and half of the Real Housewives of Atlanta star’s income.
While child support matters remain unresolved, the couple agreed that their daughter Brooklyn would live with Kenya Moore in Atlanta while Marc would have visitation rights. The exes are expected to head to trial this month to settle their dispute over child support and the division of property.
