Kroy Biermann’s is being sued after defaulting on a car loan for his Rolls-Royce Cullinan valued at approximately $400,100, and he blames Kim Zolciak.
BMW Financial Services has taken legal action against the father of six, with the lawsuit being filed on June 12. This development comes at a time when Kroy’s divorce from Kim Zolciak is already filled with conflict.
According to court documents, the car company claims that Kroy failed to make payments as agreed, leading them to take legal action. The case was filed in the Superior Court of Fulton County in Georgia.
Included in the filed petition is a copy of the lease revealing that Kroy Biermann, 37, entered into an agreement on July 31, 2020, for a Rolls-Royce Cullinan valued at $400,100.
As part of the arrangement, Kroy traded in his Rolls-Royce Wraith, which was valued at $205,000 at that time. H was obligated to make monthly payments of over $5,000 for a duration of 36 months.
By the end of the lease term, Kroy, owed a total amount of $221,763.57.
Payment records indicate that Kroy started accumulating irregular late charges in September 2020, followed by additional instances in February 2021 and October 2021.
Starting from January 2022 until April 2023, the frequency of missed payments by Kroy became more pronounced.
According to court documents, BMW Financial Services requested Kroy to return the luxury vehicle. However, they claim that he allegedly “failed and refused to surrender the vehicle.”
Kroy’s attorney, Marlys Bergstrom, blames his financial dilemma on his estranged wife, Kim Zolciak.
“Mr. Biermann never imagined that he would find himself in this position, having a car repossessed,” the lawyer told TMZ. “But this is the fallout when folks find themselves spending way beyond their means. Kroy retired and no longer receives that NFL salary. … I don’t think anyone told Kim.”
Marlys Bergstrom accused the former Real Housewives of Atlanta star of having a “detached from reality” perspective concerning financial matters.
“Every month Kroy has to scratch enough money together to pay the mortgage to save the home from going into foreclosure; they are getting collection notices and now lawsuits on behalf of creditors,” the attorney continued.
“Kim continues to spend money on online gambling, wine and things that are not necessities but luxuries. Well, now they have one less luxury item.”
In the past, Kroy has leveled accusations against Kim, exposing her out-of-control gambling habit that has had a “devastating” impact on their family.
The former Atlanta Falcons player requested Kim undergo a psychological evaluation, per court documents. The request was based on his allegations that Kim has “compulsions,” and has been spending a significant amount of time and marital funds on gambling and other games of chance.
Although the Bravo star has not directly responded to her estranged husband’s concerns, she has previously acknowledged losing $250,000 during a gambling session in the Bahamas during a family vacation.
The former couple are facing financial challenges, including owing the IRS a sum of $1.1 million in unpaid taxes, interest, and penalties from the years 2013, 2017, and 2018. Additionally, their shared home went into foreclosure in February.
As reported, financial difficulties were a contributing factor in the divorce between Kim and Kroy, but they were not the sole reason behind the decision to separate.
In recent court documents, Kroy claimed that his children need protection from their “abusive” mother, while Kim accused him of “mentally abusing,” her. These allegations have emerged as part of their ongoing legal proceedings.
Kim and Kroy, who tied the knot in November 2011, are currently engaged in a custody battle for their minor children: Kroy “KJ” Jr. (11), Kash (10), and the twins Kaia and Kane (9). The couple is seeking resolution regarding the custody arrangements for their children as part of their ongoing divorce proceedings.
