Kroy Biermann Takes Legal Action To EVICT Kim Zolciak From Their Marital Home

Kroy Biermann has filed legal paperwork to to have his estranged wife, Kim Zolciak, tossed from their Atlanta home amid their contentious divorce. 

Kroy Biermann is estranged from the Real Housewives of Atlanta alum, but the two  are still living under the same roof. Last month, Page Six reported that the ex NFL player and the former Bravo star had been “avoiding each other” while living together in their Georgia mansion. Kroy initially requested ownership of the house while Kim previously stated that she had no intention of moving out, as the pair seemingly sparred over who would be allowed to stay in the family home. 

According to legal documents, Kroy confirms that he has been living in the house with the ex-couple’s four children. He is asking the court to allow him to be “awarded exclusive, temporary, and permanent use and possession of the marital residence…in Alpharetta, Georgia.”

He also requested that his estranged wife be “restrained and enjoined from coming about the marital residence.”

Kroy’s power move comes after Kim filed for full custody of the four minor children. Kroy had previously requested sole legal and physical custody of the kids, Kroy, 11, Kash, 10, and 9-year-old twins, Kaia and Kane.

In November 2022, Kim took to her Instagram Story to deny reports that their $2.5 million home was under foreclosure. 

“I’m here until I f—king want to move out,” the Don’t Be Tardy personality declared, at the time. “‘Til I decide I don’t want to live here anymore.”

The Alpharetta property landed in foreclosure the following February, due to the couple defaulting on a 2016 loan of $1.6 million. Kim was later able to strike a deal that canceled the scheduled March 7 auction. 

The law office of Brock & Scott, PLLC, the firm managing the foreclosure proceedings, later confirmed that the auction of the home had been canceled. The terms of the deal were not made public.

Kim went on to post happy homeowner photos of Kroy cleaning the gutters,  boasting to her Instagram followers about her hot hubby. 

Kim was recently called out for teasing her alleged return to RHOA to distract from her purported gambling addiction. Earlier this month, the mom of six shared a series of photos promoting her upcoming RHOA cameo only hours before posted pics revealed the mom of six withdrawing a bundle of cash from a Bitcoin ATM. Her exposed ATM run came after Kroy accused her of having a gambling addiction. Kim was caught by the Daily Mail holding a stack of cash, seemingly $50 bills, on two days within the same week. 

The 45-year-old posed alongside RHOA star, Sheree Whitfield, and alums, DeShawn Snow and Lisa Wu, captioning the snap — ”See you soon.”

Kim Zolciak has not been asked back to the Bravo cast, despite seemingly teasing that she was set to win back her peach.
