Erika Jayne Blasted In Court Over $1.4 Million Diamond Earrings!
Erika Jayne is not happy with the latest court proceedings over the 1.4 million diamond earrings that Tom Girardi gifted her.
Real Housewives of Beverly Hills star, Erika Jayne, is in trouble with the law for refusing to hand over the set of earrings. It was revealed that Tom had used $750K of his client’s money to purchase the earrings for his wife in 2007. After making the discovery, the trustee presiding over the Girardi & Keese law firm demanded Jayne hand over the pair of jewelry so it could be sold off auction. However, the reality star refused to do so and a judge had to order Erika to hand them over. The Bravo star, through her lawyers, appealed the court’s decision to take the million-dollar earrings from her.
In her filings, Jayne had several arguments about why she should stay with the diamond earrings. The trustee responded in a recent filing that Erika has no legitimate claim to the jewelry because they were obtained with stolen money. “Mrs. Girardi has neither a legal nor equitable claim to the Earrings and, therefore, lacks standing to assert her claim. Her refusal to turn over the stolen property upon demand when told of its status is a crime, freshly committed, under California’s Penal Code § 496 (a); and, under § 496 (c) subjects her to treble damage civil liability.”
The trustee demanded the earrings be sold off in an upcoming auction. “The Trustee’s rights to possession of the Earrings are superior in law and equity to Mrs. Girardi’s desire to maintain her “rich & famous” lifestyle.” The Real Housewives of Beverly Hills star is also facing a $25 million lawsuit from the trustee demanding she returns money paid to her firm by Tom Girardi. As per the court documents, the trustee is demanding the reality star return the $25 million, her ex used to pay her the bills for her company, EJ Global.
When one Bravo fan asked Ronald Richards when Erika would get charged for not turning over the earrings, he gave a shocking response that she had already handed them in. “So when are the criminal charges being filed for not turning over the stolen property aka the earrings? It seems the next best option to strength the case.” Richards replied, “She finally turned them over.”
