Erika Jayne Accused of Theft By Fighting To Keep $750K Stolen Earrings
The bankruptcy trustee overseeing Erika Jayne’s bankruptcy case has accused the Real Housewives of Beverly Hills star of committing a crime.
Below is the trustee’s response brief for Erika Jayne’s earrings appeal. The brief accuses the former pop star of committing a crime by failing to immediately turn over stolen earrings, purchased with “embezzled” money.
“Thomas V. Girardi (“Girardi”) is a disgraced and disbarred attorney who embezzled millions of dollars from settlement funds deposited in his law firm’s client trust accounts, over a span of years,” the trustee began in a filing obtained by Radar Online on November 1. “Mrs. Girardi has neither a legal nor equitable claim to the Earrings and, therefore, lacks standing to assert her claim.”
According to the following passage taken from the recent court filing, Erika Jayne has long known that she’s wrongfully in possession of stolen goods.
“Her refusal to turn over the stolen property upon demand when told of its status is a crime, freshly committed, under California’s Penal Code § 496 (a); and, under § 496 (c) subjects her to treble damage civil liability,” they stated, proceeding to accuse Erika of attempting to keep the jewelry to “maintain her ‘rich & famous’ lifestyle.”

The pricey bling was purchased with stolen settlement funds intended for defrauded victims of Erika Jayne’s estranged husband, Thomas Girardi. He stole their settlement money from various lawsuits and used it to fund his and Erika’s lavish lifestyle.
The earrings were purchased for $750K in 2007 and have appreciated in value to $1.4 million.
The trustees are fighting Erika Jayne’s appeal and if successful will auction off the jewels on December 7, 2022, to repay the numerous victims who were ripped off by Thomas Girardi.
The now-defunct Girardi & Keese law firm operated a continuing criminal enterprise that stole more than $100 million from its clients, co-counsel, vendors, “and many others unfortunate enough to do business with the firm,” the Edelson PC law firm said in a federal lawsuit.
Girardi & Keese siphoned off settlement payments to family members of plane-crash victims, women who developed breast cancer after taking hormone replacement therapy, and others who hired the plaintiffs’ firm.
Twitter attorney, Ronald Richards, wasted no time adding his two-cents — shading the Real Housewives of Beverly Hills star:

“Here is one main brief arg: ‘The sale is to take place on December 7, 2022. The unstayed authorization of the unstayed sale renders Mrs. Girardi’s appeal moot.’ Sale ord. below,” he tweeted. “Why is [Erika Jayne] taking money from her benefactor to pay for this appeal w/o a stay? Makes no sense.”
