“You just want to shake her and go, ‘Honey, they were never yours,’” the Mad Men alum said during a Monday appearance on Sirius XM’s “The Howard Stern Show.”

The actor also questioned the actual value of the diamonds, which were purchased for $750k but could be worth up to $1.3 million.

“Give them back,” Jon, 51, said.

Erika stated in court documents that she wanted the ongoing investigation to play out before returning the pricey earrings. The RHOBH cast has been debating Erika’s actions regarding the earrings, which Erika proudly wore in the most recent episode.

The trustee overseeing Tom’s bankruptcy case previously sued the Bravo star to turn over the earrings, which were purchased in 2007. The trustee alleged that funds held in a client trust account at Girardi’s defunct law firm were used to purchase the diamonds.

Page Six obtained the court filing and reported that Erika was maintaining her innocence.

“First, Erika is completely innocent,” her attorney Evan Borges, stated at the time.

“Not even the trustee alleges that Erika knew the source of funds that her wealthy husband used to buy her a gift of earrings 15 years ago (which replaced a prior set of earrings bought years prior to that).”

On June 28, a Los Angeles judge ruled that Erika must hand over the earrings because they were paid for with misappropriated settlement money. The judge put the trustee in “possession and control” of the earrings, ordering him to hold the property until the jewelry could be appraised, “at which time the Trustee may notice a sale of the diamond earrings.”

The judge noted that Erika’s supposed lack of awareness of Tom’s alleged crimes had no relevance, and ordered that the earrings be turned over as property of the estate.

“This is an unfortunate case,” a lawyer for the trustee said as stated in open court, per Law.com. “The facts as far as I am concerned are pretty straightforward: There was embezzlement fraud from Day 1, not by Erika Girardi but Mr. Girardi. And the facts are laid out in the record. The trustee gets the record the best she can.”

Erika filed an appeal a month later, in an effort to keep the diamonds.

Erika filed for divorce in November 2020, one month before Tom and his firm, Girardi Keese, were forced into a Chapter 7 bankruptcy. Tom is embroiled in multiple lawsuits accusing him of embezzling funds owed to clients—including orphans and widows of plane crash victims and a gas explosion burn survivor.
