RHOBH: Diana Jenkins’ Energy Drink Company Forced To Pay $500K Amid Claims Of Misleading Consumers!

Real Housewives of Beverly Hills newbie, Diana Jenkins, was forced to pay out $500k after her energy drink company was accused of misleading customers, in 2016.

Radar Online reports that documents prove that Neurobrands LLC agreed to pay out half a million dollars in penalties and restitution after an investigation determined that “the Neuro drinks in question lacked the necessary scientific evidence to back up many of the health-related claims advertised.”

The new Bravo star’s brand was released in Target stores in 2013, three years ahead of the reported settlement. The drink assortment at the time included Neuro Sonic, Neuro Daily, Neuro Bliss, and Neuro Sleep.

The drink brand, which was launched in 2007, promised to support memory, mental energy, focus and creativity. The brand also claimed to boost healthy aging, normalize sleeping patterns, provide relief from muscle cramps and enhance one’s mood.

The Santa Monica City Attorney and Los Angeles County District Attorney’s Offices both refuted the brand’s claims. 

“Words matter,” Adam Radinsky, Santa Monica’s Chief Deputy City Attorney for Consumer Protection, said about the products, at the time. “Especially as more and more people become concerned about what they eat and drink, a product’s health claims need to be fair and accurate.”

“If something is claimed to have health benefits, the manufacturer needs to back that up with reliable scientific evidence.”

Neurobrands did not cop to any responsibility. However, Diana’s energy drink company not only paid out $500k but was also hit with a long list of requirements, via a permanent court injunction. The company was ordered to “stop using the ad claims listed above unless supported by new scientific evidence.”

The RHOBH star’s business was also told that it would be required to “maintain competent and reliable scientific evidence to support all future health-related claims” and “conduct additional scientific studies of its drinks to support future claims.”

The court also required the brand to alter its marketing and branding policies, as well. 

“Clarify that they are conventional beverages, not ‘dietary supplements,'” the documents read. “Change the marketing and branding of Neuro Sleep to treat it as a true dietary supplement, not a beverage,” the court instructed, as well as “assure that the caffeine level in Neuro Sonic conforms with FDA food safety requirements.”

Diana has landed in multiple scandals since she made her debut on the Bravo show. The RHOBH rookie recently landed in controversy after she made a “racially insensitive remark” amid an Instagram beef with “Philly Diva,” a black woman who runs a Bravo fan account. Diana made a crass remark in response to the woman pointing out changes in the reality star’s appearance, over the years. 

“It can’t feel good being a Black content creator,” Diana wrote, in part.

She later apologized for her remark, after she was blasted by outraged fans.   

“I assumed ‘Black content creator’ was a title referring to a page that would be focused on snarky content,” Diana explained. “I copied the term because I thought that’s what it meant. I didn’t realize it was referencing to you as a Black woman and a content creator.”
