Erika Jayne Battles To Keep Her $1.4 Million Earrings!

Erika Jayne is not giving up her $1.4 million earrings without a fight. 

Court docs obtained by Radar Online reveal that the lawyer repping the Real Housewives of Beverly Hills star has claimed that the jewels belong to his client, and should not be sold off to pay the debts of her estranged husband, Tom Girardi.

The trustee overseeing the disbarred lawyer’s bankruptcy case sued Erika to force her to turn over the earrings, which Tom purchased in 2007 for $750k. Tom, 82, was accused of using funds owed to clients to pay for the lavish gift.

The trustee’s ongoing lawsuit seeks to pay back multiple former clients of the once famed attorney— including orphans, widows, and a burn victim. Tom has been accused of embezzling settlement money owed to clients in order to support the couple’s luxury lifestyle and Erika’s singing career. 

The Bravo star initially refused to surrender the earrings but finally turned them over in order to have them appraised. 

Erika’s attorney wrote in a new motion—“the trustee seeks to recover a marital gift from an innocent spouse solely for the purpose of recovering the asset in question for the benefit of other creditors of [Girardi] who never had any right to the funds in question.”

The attorney also argued that the statute of limitations had expired, and claimed that the earrings were purchased with money from an “express trust.” Her lawyer said that the law states that “funds held by a debtor under an express trust for another are not the property of the estate.”

Erika, 50, filed a declaration with the motion writing—“I am not and never have been an attorney. My career during my marriage to Mr. Girardi was an entertainer.”

“During our marriage, I believed [Tom Girardi] and [his firm] were financially successful, extremely wealthy and made large amounts of money,” she said.

She added that her then-husband bought her an expensive pair of diamond earrings in 2004 or 2005 for either her birthday or their wedding anniversary. 

“This gift had high sentimental value,” the Bravo star said.

She claimed that the earrings in question replaced the first pair, which were stolen by burglars. The reality star added that she believed that Tom had the cash to pay for the expensive gift. 

In May, Erika spoke to Us Weekly about where she stood with her estranged ex, ahead of the Season 12 premiere of RHOBH.  

“I still am mourning that marriage,” the “Pretty Mess” personality told the outlet. “I think that gets lost in the sensationalized version of it all. This was someone I was married to for over 20 years and was with, like, 23 [years]. It’s difficult. There are real moments of sadness, real moments of — like when the holidays came around, you know, for Christmas, I would just remember how much fun we would have. … But what are you going to do with that? These things happen in life. They happen to everyone; everyone’s mourning something.”
