Thomas Ravenel’s assault case is trial bound.

In a preliminary hearing on Monday, a South Carolina judge found probable cause for the second-degree assault and battery charges levied against the former Southern Charm star.

Ravenel was not present in the courtroom, but his accuser and former baby nurse, Dawn Ledwell, made an appearance.

Thomas Ravenel was arrested and charged with assault and battery in late September, after Ledwell accused him of rape in May. Ledwell claimed the alleged incident occurred in 2015, while she was employed to care for the daughter Ravenel shares with ex-girlfriend, Kathryn Dennis, Kensington Ravenel.

“Although I believe he should be in jail for his crimes, the reality according to statistics is that he will go unpunished,” Ledwell told PEOPLE, after she went public with her story.

Thomas Ravenel, 56, has denied Ledwell’s claim. In a sad twist, Ravenel’s attorney and longtime friend, Richard P. Terbrusch, was killed in a plane crash in October.

Bravo and Ravenel parted ways after Season 5 of the Bravo reality hit wrapped.

No trial date has been set.
