Attorney James Leonard LIED About Joe Giudice’s Deportation Status — Judge Ordered #RHONJ Star Removed From US!

Despite recent statements from the attorney of Giuseppe “Joe” Giudice, husband of Real Housewives of New Jersey star, Teresa Giudice, deportation of the reality dad has been determined.

On March 14, 2018, an immigration judge ordered Giudice be removed from the United States, an official for the U.S. Department of Justice Executive Office for Immigration Review informed Radar Online

This judgement contradicts a June 2018 statement made by Giudice family attorney, James J. Leonard Jr.

“I can state with absolute certainty that no decision has been made regarding the immigration status of Joe Giudice,” Leonard Jr. told PEOPLE in regards to deportation of the reality star.

He continues: “The same immigration detainer that was lodged against him in March of 2016 remains in place today, but I want to be absolutely clear about this, no judicial authority has made any decision regarding what will happen with that detainer.”

In March 2016, Giudice began serving a 41-month prison sentence for mail, wire and bankruptcy fraud in federal prison. His expected release date is March 2019. However, unlike his wife Teresa (who served 15 months in the federal pen for fraud), he is not a U.S. citizen. The reality dad is an Italian citizen, who has a status of “Permanent Resident of the U.S.,” and has lived in America since he was a toddler.

Giudice
, who started his sentence at the Federal Correctional Institution at Fort Dix in 2016, was recently transferred to prison in Allenwood, Pennsylvania, where he could participate in hearings on his immigration status. 

Upon his prison release in 2019, the father of four will be immediately detained and escorted by Immigration and Customs Enforcement (ICE) agents to an immigration detention facility, where he will be held pending deportation to the Italy.  

The 46-year-old, who no longer has ties to his native Italy, is frantically appealing the U.S. Immigration decision to remove him from the United States.

“Mr. Giudice applied for a cancellation of removal on May 8, 2018, and filed a motion to terminate on May 24,” the DOJ official told Radar. “Both requests remain pending.”

As reported, the likelihood of Giudice returning home to his family is dim, given the severity of his crimes — classified as “moral turpitude” and “aggravated felonies.” Despite having lived and worked in the U.S. for over 44 years, being married to a U.S. citizen for nearly 20 years, and having four children in this country —  his crimes almost guarantee extradition.  Giudice has arrests and convictions spanning over two decades:

  • Assault (Joe smashed a woman’s head into a mailbox in 1992)
  • Bank fraud
  • Bankruptcy fraud
  • Identity fraud (2014 conviction for using his brother’s identity to obtain a new license after he lost his because of a drunk-driving conviction)
  • Tax evasion
  • Multiple DUIs resulting in convictions and jail time 
  • Driving on a suspended license (Joe’s had his driver’s license suspended more than a dozen times)

Unfortunately, the reality bad boy is currently “in denial” over his fate, “He’s convinced he’s not getting deported,” an insider tells Radar. “He says it’s not going to happen.”
