Not even jail can stop former Real Housewives of Orange County star, Lauri Peterson‘s son from a life of crime!

Josh Waring has been charged with another felony — possession of a controlled substance and being under the influence — while in custody at the Orange County Central Men’s jail.

On June 19, the District Attorney filed the new felony charge against Waring, with a misdemeanor charge for allegedly being under the influence of a controlled substance, reports Radar. The violation date is listed as December 10, 2016.

In 2016, Josh was charged with attempted murder in connection with a June 20, 2016 incident, in which he’s accused of shooting a 35-year-old man, then stealing a BMW SUV to flee the scene.

The former reality star allegedly shot Daniel Lopez, in the lower torso, outside of a sober living residence. As reported, Waring and Lopez got into a confrontation at the sober home earlier that day, then he returned to the Costa Mesa location around 2:00 am, and shot Lopez. Luckily, the victim survived.

Josh‘s mother, former RHOC star Lauri Petersen, adopted his daughter in 2015, amid his ongoing personal problems.

So far, this is Waring‘s third criminal offense committed from the slammer. In November 2016, Waring, “knowingly and unlawfully,” kept pruno – a jailhouse alcoholic beverage – while in custody, and was charged with felony possession of a controlled substance in that same month.

This latest drug charge is happening just weeks before his attempted murder trial is expected to begin.

Waring, whose bail was set at $1 million, has pled not guilty to three counts of attempted murder and remains behind bars since his 2016 arrest, unable to post bail.
