‘Sister Wives’ Taking Their Polygamy Lawsuit To The Supreme Court

Kody Brown and his female cheering section have been given a shot to plead their case to the highest court in the land.

The Sister Wives stars’ lawsuit challenging Utah’s historic ban on plural marriage is still kicking, and they have until September 10th, to file a “petition of certiorari,” to have the nation’s top court review their case. U.S. Supreme Court Justice, Sonia Sotomayor, granted the family the time to file the petition, allowing them to keep their pro-polygamy legal battle alive.    

Kody and “wives,” Meri, Janelle, Christine and Robyn, sued the state of Utah in 2012, in an effort to topple the state’s ban on plural marriage. The move was triggered by a supposed investigation, triggered when the family revealed their plural status on the TLC reality show. The family argued that the ban infringed on their religious freedom and right to privacy.

In April, the 10th U.S. Circuit Court of Appeals in Denver shot down the effort, because the Browns never faced charges, and local authorities later said that they would not prosecute consenting adults with multiple wives. The panel reversed a 2013 decision made by U.S. District Judge Clark Waddoups, who believed that a threat of prosecution drove the Browns out of Utah, and that key parts of Utah’s bigamy law violated their rights.

The Supreme Court has not heard a polygamy case in over 100 years. The Browns lawyer, Jonathan Turley, tweeted on Friday, that the filing will be made on Monday.

There are an estimated 30,000 polygamists in Utah. They believe that practicing polygamy brings the highest heavenly exaltation—a belief from the early Mormon church. The mainstream Church of Jesus Christ of Latter-day Saints dropped the practice in 1890, and strictly forbids it today.
