Bethenny Frankel has shed many tears on-screen over her ongoing divorce from Jason Hoppy, blaming him for insisting on staying in the apartment she says she worked her “whole life to buy.” The couple renovated and lived in a gorgeous Tribeca apartment during their brief marriage which ended in late 2012. Nearly three years after their split, “The Real Housewives of New York” star continues to battle her ex for the home Skinnygirl built. But now there seems to be some light at the end of the tunnel in the ongoing fight over her the apartment.

According to a new report, there’s a high probability Jason will be kicked to the curb from the residence. Hoppy’s marital home with Frankel was purchased by a trust and the trust should be awarded the property post divorce. And due to the fact, Bethenny purchased the property with her money, funded by a loan in the amount of $2,300,000.00 and by approximately $2,700,000.00 from an account in Bethenny’s name, she feels the trust should be assigned to her. Frankel also claims she should not have to pay Hoppy spousal support because of an agreement they signed in 2010. Frankel’s legal team released the following statement:

“On March 12, 2010 the parties executed their Prenuptial Agreement in which they mutually waived spousal maintenance from the other ‘both now and in the future.’ The award of any temporary maintenance, even for one year, was error as a matter of law.”

As previously reported, in May 2015 a judge declared that documents used to secure a trust for Frankel’s and Hoppy’s Tribeca apartment is null and void.

In addition, there’s major discrepancy of Jason’s mother’s credentials to notarize in New York State. Carol is a notary in Pennsylvania, and her stamp and signature appear on some of the documents, however the documents state, “that she is a ‘notary public in and for the State of New York,’” which is false according to Bethenny “[Carol] does not deny, that neither party” ever went to Pennsylvania to sign the forms.

Bethenny Frankel and Jason Hoppy wed in 2010 while filming their a reality show for Bravo. The couple have one child together, a four-year-old daughter, Bryn
