As reported earlier this week, Kim Richards, 50, had supposedly struck a plea deal in connection with her drunken rampage arrest in April of this year. Richards was formally charged with public intoxication, resisting arrest and battery on a cop.

On Monday, Richards’ attorney appeared in court on her behalf to finalize a sweet plea deal for the former Real Housewives of Beverly Hills star. Richards’ pled no contest to being drunk in public at the Beverly Hills Polo Lounge. Kim was not present for the hearing.

Now, People magazine is reporting that Kim Richards did not accept that plea deal for her April public intoxication arrest.

“There were conversations about a negotiated settlement being offered by our office, but the offer was rejected by the defense,” Santiago says.

Richards, was due to appear at the hearing but missed it due to a foot injury.

“She didn’t attend because she had some sort of injury to her foot, and therefore couldn’t appear,” Ricardo Santiago, spokesperson for the Los Angeles County District Attorney’s office, tells PEOPLE. “The judge accepted the explanation and allowed her attorney to appear on her behalf.”

Details of the plea agreement stipulate: 3 years probation, 52 AA classes, and 30 days community labor and NO jail time. Kim must stay away from the Beverly Hills Polo Lounge. Richards attorney told the prosecutor Kim can’t do labor tasks due to a foot injury. Prosecutors requested Kim’s medical records to support her medical exemption.

A pre-trial court date is set for Sept. 14. If the case goes to trial and Richards is found guilty, the reality star could face jail time.

Kim is a former child actor who has struggled with addiction for many years. Her troubles began shortly after the RHOBH season 7 reunion aired, she was arrested at the Beverly Hills Polo Lounge for a drunken rampage. Next stop, Dr. Phil. Three days later, the former reality star entered a Malibu substance abuse program, but doesn’t stay. She then went to her daughter’s second wedding in Los Cabos, causes a scene, fires sober coach, runs off with no contact to family or friends. Then on August 2, the recovering addict was arrested for shoplifting from a Target store in Van Nuys, California.

Kim is still facing charges in her Target theft case. Richards was due in court on August 20 for the Target arrest but was given a reprieve when the judge in the case agreed to move the court date to September 11. The new date gives Kim’s lawyer, Sara Caplan time to review the police report and surveillance video with her client. Caplan, told the judge that Kim is back in “program” and plans to stay there.
